(See Attachment 1, Pages 1-2) RECOMMEND APPROVAL *************************************************** Substitute Item 2 Brandy Branch Site Land Use Order/Jacksonville Electric Authority REQUEST: Consideration of an Order, to be executed by the Siting Board, adopting the Administrative Law Judge's Recommended Order recommending the Siting Board find the Brandy Branch site to be in compliance with local land use plans and zoning ordinances for the location, construction and operation of the Brandy Branch Combined Cycle facility, pursuant to Subsection 403.508, F.S. COUNTY: Duval APPLICANT: Jacksonville Electric Authority APPLICANT: The Brandy Branch power plant is located on a previously permitted site in an unincorporated area of Duval County, Florida northeast of Baldwin. STAFF REMARKS: The proposed combined cycle conversion project consists of converting two combustion turbines already under construction by adding two heat recovery steam generators and a single steam turbine for operation as a combined cycle unit. An additional simple cycle combustion turbine unit is already under construction on the site. The site will have a nominal generating capacity of 745 megawatts (MW). The new power plant will be fired with natural gas as the primary fuel with low sulfur No. 2 oil as a backup. The site occupies approximately 153 acres. Additional facilities included in the project include a cooling tower, water and wastewater treatment facilities, fuel oil and water storage tanks, a natural gas pipeline lateral with delivery and metering facilities, and a 230 kV transmission line, transformers and switching gear necessary to connect to the grid. On July 5, 2001, the Administrative Law Judge (ALJ) issued his Recommended Order recommending the Siting Board find the Brandy Branch site to be in compliance with local land use plans and zoning ordinances. However, that Land Use Order contains a condition that the air emission and stack height requirements of the City of Jacksonville's Planned Unit Development (PUD) zoning ordinance be met an approved at some future point. Stanton Energy Center (Combined Cycle Unit A) Final Order/Southern Company-Florida, L.L.C./Orlando Utilities Commission/ Kissimmee Utility Authority/Florida Municipal Power Agency REQUEST: Consideration of an Order, to be executed by the Siting Board, adopting the Administrative Law Judge's Recommended Order recommending the Siting Board grant full and final certification to Orlando Utilities Commission, Kissimmee Utility Authority, Florida Siting

Municipal Power Agency, and Southern Company Company-Florida, L.L.C., under Section 403, Part II, F.S., for the location, construction and operation of the Stanton Energy Center Combined Cycle Unit A, pursuant to Subsections 403.509(1), and 403.511(1), F.S. COUNTY: Orange APPLICANTS: Orlando Utilities Commission, Kissimmee Utility Authority, Florida Municipal Power Agency, and Southern Company Company-Florida, L.L.C. APPLICANT: The Curtis H. Stanton Energy Center power plant is located on a previously certified site in an unincorporated area of Orange County, Florida southeast of Orlando. STAFF REMARKS: The proposed combined cycle unit A consists of two combustion turbines, two heat recovery steam generators and a single steam turbine operating as a combined cycle unit, with a nominal generating capacity of 633 megawatts (MW). The new power plant will be fired with natural gas as the primary fuel, with low sulfur No. 2 oil as a backup. The Curtis H. Stanton Energy Center site is a previously certified site of approximately 3,280 acres. Additional facilities in the project include a cooling tower, water and wastewater treatment facilities, fuel oil and water storage tanks, a natural gas pipeline lateral with delivery and metering facilities, and a 230 kV transmission line, transformers and switching gear necessary to connect to the on-site substation. The Florida Public Service Commission issued an affirmative need determination on May 14, 2001. On October 21, 1981, the Siting Board found the site to be consistent and in compliance with existing land use plans and zoning ordinances. On July 23, 2001, the Administrative Law Judge issued his Recommended Order recommending the Siting Board grant certification to Orlando Utilities Commission, Kissimmee Utility Authority, Florida Municipal Power Agency, and Southern Company Company-Florida, L.L.C., under Section 403, Part II, F.S., for the location, construction and operation of the Curtis H. Stanton Energy Center Combined Cycle Unit A subject to the Conditions of Certification. (See Attachment 3, Pages 1-120) RECOMMEND APPROVAL
