Consideration of a Petition to Establish the Bartram Springs Community On March 20, 2002, SouthStar Development Partners, Inc., submitted a petition to establish the Bartram Springs Community Development District (CDD) pursuant to Chapter 190, F.S. The land area proposed to be served by the Bartram Springs CDD consists of approximately 1,025 acres. All proposed lands are within the City of Jacksonville, a consolidated government that has jurisdiction over and extends territorially to the limits of Duval County, Florida. The Bartram Springs CDD is generally located west of U.S. 1, east of Interstate 95, and south of St. Augustine Road in Duval County. There are no out-parcels located within the external boundaries of the parcel of land to be included in the District. The Petitioner has written consent to establish the District from the owners of 100% of the real property located within the District. The District, if established, intends to participate in the construction of certain road and entranceway improvements. The District is also expected to provide certain stormwater and recreation amenity improvements for the lands within the District, as well as wetland restoration and funding for a roadway planning, development, and engineering study. Upon request of the Secretary, the Department of Community Affairs (DCA) reviewed the petition from the standpoint of its programs and responsibilities, and the requirements of section 190.005(1)(e), F.S. On April 18, 2002, the DCA submitted a letter indicating the Department did not find any inconsistencies with either the comprehensive plan or the approved development order. Pursuant to Chapter 190, F.S., a public hearing was conducted by the Division of Administrative Hearings (DOAH) on May 31, 2002, in Jacksonville, Florida. The DOAH Administrative Law Judge submitted a Report to the Commission on June 21, 2002, making affirmative conclusions on all six factors, pursuant to section 190.005(1)(e), F.S. Pursuant to Chapter 120, F.S., notices of proposed rulemaking were published in the Florida Administrative Weekly. No public hearings were requested and no written comments were received as a result of the notices. Approve the proposed final rule and authorize the Secretary to file for final rule adoption.
