The Office of the Insurance Regulation
is
8 seeking adoption of
emergency rule 690ER04-10
which
9 provides for -- that rule
requires insurers
to
10 extend for personal
residential and
commercial
11 residential insurance
coverage for sustained
damage
12 as a result of 2004
Hurricane or Tropical
Storm
13 Bonnie a 60 day period from
the date the
dwelling
14 has been repaired and
becomes
insurable.

The purpose of the rule is to extend
from
16 January 1, 2004, until
March 31st, 2005 --
excuse
17 me, January 5, 2005 to
March 31st, 2005,
to
18 effectuate the rule to
prevent noncancellation
or
19 nonrenewal of policies that
have been damaged as
a
20 result of the
storms.

COMMISSIONER GALLAGHER: I have one
amendment
22 I want to add to that rule,
Governor.

It would be number 4, to add "upon the
request
24 of the insured," and then
renumber
subsequent
25
sections.

That will allow -- actually if you read
this
2 rule strictly, an insured
couldn't cancel
his
3 policy; so in order to allow
that to happen,
that
4 will add number 4
there. If the person who
was
5 buying the insurance doesn't
want to continue
it
6 and wants to get it
somewhere else, that's
their
7
choice.

MR. McCARTY: We would agree with
the
9
amendment.

GOVERNOR BUSH: Any discussion? Is there
a
11
motion?

COMMISSIONER GALLAGHER: Move
it.

Kevin, our intent here is to work intensely

16 get the legislature to
change the law so that

correct.

GOVERNOR BUSH: -- we have in law what
we
19 have been doing by
emergency
rule?

MR. McCARTY: Right. We are able
to
21 accomplish this
administratively, but we would
be
22 working with the House and
Senate leadership
and
23 staff members to put
together a piece
of
24 legislation that would
codify the intent of
this
25 emergency
rule.
