ITEM 2. Request approval of and authority to file with the Secretary of State under Chapter 120, F.S., proposed repeal of Rule Sections 12D-1.001 and

12D-1.002, Florida Administrative Code. (Attachment 2)

12D-1.001 Reference to Statutes

12D-1.002 Definitions

The proposed repeals are designed to remove language that is obsolete, unnecessary, or that paraphrases the statutes. Rule Section 12D-1.002(7) is being repealed because it contains an incorrect definition of "tangible personal property".

ITEM 3. Request approval of and authority to file with the Secretary of State under Chapter 120, F.S., proposed amendment to Rule Chapter 12D-7, Florida Administrative Code, Exemptions. (Attachment 3)

12D-7.011 Homestead Exemptions--Trusts

The proposed amendment will delete obsolete and conflicting provisions which relate to the entitlement of homestead exemption for the beneficiary of a trust. Additionally, it will amend the rule to include both passive and active trusts as required by AGO 90-70.

ITEM 4. Request approval of and authority to file with the Secretary of State under Chapter 120, F.S., proposed amendment of Rule Section 12D-13.001, Florida Administrative Code. (Attachment 4)

12D-13.001 Definitions

The proposed amendment repeals two subsections which contain definitions that paraphrase the statutes and are unnecessary.
