22 I'd like to ask, Governor, if I might, give us
23 an update on where we are and what the outlook
24 appears to be.
25 MR. HERNDON: For the balance of the Fund?

1 TREASURER NELSON: Yes, sir.
2 MR. HERNDON: Okay.
3 Well, as you know, performance for the last
4 several years has been very strong.
5 Unfortunately the equity market in particular,
6 and the international equity market in addition,
7 have both experienced substantial correction in
8 the period from July 17th, which was the peak of
9 the high in the U.S. equity market until today.
10 At the close of business on Friday, the
11 market had -- fell, depending on the index that
12 you like to use, whether it's the Dow Jones
13 industrial average, or the S&P 500, or our own
14 particular benchmark, anywhere from
15 twelve-and-a-half to 13 percent, to something on
16 the order of 17 percent in the U.S. equity
17 market.
18 Internationally, of course, equity markets
19 have suffered an even more substantial decrease,
20 at some points, as much as 30 percent in some of
21 the emerging markets.
22 We haven't been immune to those losses.
23 And the portfolio of the Board has decreased in
24 value approximately 12.73 percent. Now, that's
25 in contrast to the Dow Jones industrial average,

1 for example, which lost 15.4 percent; or the
2 S&P 500, which lost 17 percent.
3 But, as you know, we're a very diversified
4 fund, so we have our own tailored benchmark
5 against which we measure performance. And that
6 benchmark is a weighted average, if you will, of
7 the other benchmarks, and -- so in that regard,
8 looking at our own specific performance index,
9 we have suffered less than our performance index
10 would have led you to believe.
11 For example, our total fund benchmark
12 return fell by 12.95 percent. We fell by
13 12.73 percent. It's a fairly small difference,
14 22 basis points. But that's very significant on
15 a fund our size.
16 And that's one of those unfortunate
17 situations where we've all suffered from the
18 market correction, but we've suffered less than
19 our benchmark would have led you to believe.
20 We are optimistic about the market in the
21 long run. As you know, Commissioner, we're
22 long-term investors. We're here for the long
23 pull.
24 And, in fact, over the course of the last
25 three months, we have been employing the

1 discipline that the Board has adopted for us by
2 rebalancing against our various benchmarks. We
3 have been taking advantage of a very substantial
4 market on the bond side, on the fixed income
5 side, and have moved monies out of the bond
6 market to try and capture what we believe is
7 that long-term incremental gain in the equity
8 market.
9 And we've seen, coincidentally, frankly,
10 some very nice results as a consequence of those
11 rebalancings. But, again, we're here for many,
12 many years, and we anticipate that that will
13 serve us well.

1 just a couple of comments to -- as a postscript
2 to my comments last meeting about the Cat Fund
3 and our --
4 GOVERNOR CHILES: Yes, sir.
5 MR. HERNDON: -- anticipated experience as
6 a result of Hurricane Georges.
7 We hope to have by the end of this week the
8 first preliminary claim information from the
9 various companies writing property and casualty
10 insurance in the state. As a matter of fact,
11 the first preliminary estimates are due on
12 October 15th.
13 And those are still preliminary, and we
14 anticipate that there will be some last minute
15 revisions.
16 But as it looks right now, there appears to
17 be a small chance that we will have some
18 disbursements out of the Cat Fund for a few
19 companies. We're -- we're not absolutely
20 certain, and we won't be absolutely certain
21 until December 31st when we get the final
22 figures in, which is when the companies are
23 required to report to us. But we don't
24 anticipate more than a few million dollars.
25 As you recall, even in Erin and Opal, which

1 had cumulatively less damage in some regards,
2 the Cat Fund did have to disburse a few million
3 dollars for both of those storms.
4 So we're optimistic, the Cat Fund is
5 sitting on two-and-a-half billion dollars worth
6 of cash. Of course, it's all invested. But we
7 do anticipate that there may be a slight
8 disbursement out of that fund.
9 And as soon as we get that information on
10 the 15th, we -- it'll take us a few days to
11 digest what we get, and then we'll get a report
12 to each of you as to what the preliminary
13 numbers forecast are.

19 The applicant has -- the applicant has
20 inserted a clause into the Golden Gate purchase
21 agreement requiring the Board of Trustees to
22 grant their application to this extended lease
23 as a condition precedent to the acquisition of
24 their property.
25 I do not believe it is in the best interest

9 we TP Item 9, take up Item 10.
10 In the Item 10 issue, I will then move to
11 strike the condition precedent language from the
12 Golden Gate purchase agreement, then we can go
13 back to -- to Item Number 9.

17 For the record, my name is
18 David Guggenheim. I'm President and CEO of the
19 Conservancy of Southwest Florida based in
20 Naples. We are southwest Florida's leading
21 conservation organization, now in its 35th year.
22 We have -- I am speaking on behalf of our
23 5500 members, and 675 volunteers.
24 I'm also the Florida Cochair of the
25 Everglades Coalition.

1 We respectfully urge you to approve the
2 State's purchase of the environmentally
3 sensitive lands in South Golden Gate Estates
4 from Avatar Properties.
5 This purchase agreement is the culmination
6 of more than a year-and-a-half of negotiations,
7 and will bring public ownership of
8 South Golden Gate Estates up to nearly
9 75 percent, a dramatic step forward for this
10 project.
11 Without the Avatar acquisition, the
12 restoration of South Golden Gate Estates cannot,
13 and will not, succeed.
14 It is important that you understand just
15 how important this restoration is to the
16 citizens of southwest Florida, and all
17 Floridians, who will benefit tremendously when
18 South Golden Gate Estates becomes a permanently
19 protected environmental and recreational
20 resource, Picayune Strand State Forest.
21 South Golden Gate Estates connects
22 Big Cypress National Preserve and the
23 Fakahatchee Strand to the Ten Thousand Islands
24 National Wildlife Refuge. This acquisition will
25 allow historic water flows to be restored,

1 helping wildlife, plant, and nearshore species
2 to recover.
3 On each day that passes without this
4 restoration, more than 400 million gallons of
5 freshwater, which once made its way gradually as
6 sheet flow over South Golden Gate Estates, is
7 diverted to the Faka Union Canal, inundating
8 parts of the Ten Thousand Islands with too much
9 freshwater, while other parts are starved for
10 too little freshwater.
11 This has had a devastating impact on the
12 local estuarine environments.
13 As Secretary Wetherell completes this, her
14 last Cabinet meeting, I think she can be very
15 proud of the new life she gave to the
16 South Golden Gate Estates project. And -- and
17 for that, we are very, very grateful.
18 We owe thanks to Secretary Wetherell,
19 Kirby Green, Pete Mallison, Ed Kuester,
20 Mike Ashey, and the others who have really
21 given this project focus and a businesslike
22 approach.
23 They have earned tremendous respect and
24 support from local leaders, including local
25 government leaders, in southwest Florida by

1 putting this program on track, demonstrating
2 results, and restoring confidence in government

6 government representatives in southwest Florida,
7 including Chairman Berry of the Collier County
8 Commission; Commissioner Ray Judah from the
9 Lee County Commission; Representative-Elect
10 Dudley Goodlette; and Senator-Elect,
11 Burt Saunders, all speaking in favor of -- of
12 this acquisition.
13 I believe you've also received upwards of
14 200 phone calls, and between 50 and 100 faxes
15 and letters on this item from citizens of
16 southwest Florida responding to -- to some media
17 coverage of this -- of this decision, and
18 expressing their support of this -- of this
19 purchase.
20 As we speak, Vice President Gore is in
21 West Palm Beach at the South Florida Water
22 Management District headquarters announcing the
23 release of the central and south Florida
24 restudy, the master plan for the restoration of
25 the Everglades, the largest environmental

1 restoration ever attempted in the history of
2 civilization.
3 In southwest Florida, now the fastest
4 growing part of this state, and one of the

6 desperate to protect and preserve and restore
7 our fragile corner of the Everglades ecosystem,
8 and not to repeat the mistakes that were made on
9 Florida's east coast.
10 Restoration of South Golden Gate Estates is
11 essential to ensure that we stay the course.
12 On behalf of our members and our beloved
13 Everglades, I again urge you to approve this
14 acquisition. I thank you for the opportunity to
15 speak, and for your consideration.

19 Mr. -- Governor, and Cabinet, that I have done
20 some thorough investigation on the land. I'm
21 not sure that you have had a chance to see a
22 report on it. And I thought that maybe I could
23 bring something to mind that may have some
24 influence on your decision as to whether to
25 accept or reject my bid.

1 As -- as we speak, the land is in a
2 moratorium in Duval County. It is presently
3 zoned RR, which is --

6 MR. PREVATT: -- 1 acre per residence.
7 If you could utilize the land, you could
8 get five lots out of it. The only problem with
9 that, the moratorium is on concurrency and
10 infrastructure, which would take a
11 mile-and-a-half of four-lane road to bring it
12 up-to-date.
13 So my bid was just really a bid not based
14 on the actual value, but on a -- on a bid that
15 was what could you tie up for an indefinite
16 period of time waiting for something to happen
17 to a piece of land.
18 It is impossible to do anything with the
19 land now. It's not even economical if it --
20 to -- to try to build anything on it. And if
21 ever down the way, other than one home site, you
22 would have to put in the roads and the water and
23 the sewer. And the shape of the property is
24 such that you could at that time only procure
25 some three to five lots in a neighborhood where

1 the surrounding houses are selling from a
2 hundred and fifteen to a hundred and

8 money are we going to be recouping from this?

13 grazing lease.

15 That's -- I guess the only person that made
16 out was the appraiser -- was the appraiser. We
17 should have given it to him for the price of the
18 appraiser, you know.

21 only comment. I don't have any objection to it,
