Item 2 Cane Island Power Park Final Order/Kissimmee Utility Authority/Florida Municipal Power Agency

REQUEST: Consideration of an Order to be executed by the Siting Board, adopting the Administrative Law Judge’s Order of Adoption and the related Findings of Fact, Conclusions of Law and Corrected Recommended Order recommending that the Siting Board grant certification of the Cane Island project subject to the Conditions of Certification.

COUNTY: Osceola

APPLICANTS: Kissimmee Utility Authority (KUA) and Florida Municipal Power Agency (FMPA)

LOCATION: The existing Cane Island Power Park is located approximately five miles west of the Kissimmee city limits and one mile north of Intercession City in western Osceola County.

STAFF REMARKS: The KUA and FMPA wish to expand their generating capacity by constructing a 250 megawatt, high efficiency, natural gas-fired, combined cycle generating unit on KUA’s existing Cane Island Power Park site. The project includes construction of a mechanical draft cooling tower utilizing treated sewage effluent from the City of Kissimmee, water and wastewater treatment facilities, fuel oil and water storage tanks, a storm water detention pond and a short 230 kilovolt transmission line that will interconnect with Florida Power Corporation’s Intercession City Generating Plant, which is located approximately one-fourth mile west of the Power Park boundary. Low sulfur, distillate fuel oil will be a backup fuel in case of a temporary curtailment on the use of natural gas. Currently KUA operates two natural gas-fired generating units on site. The entire existing 1,026.5-acre site is proposed for certification, with 876.1 acres described in a dedicated conservation easement scheduled for protection and 150.4 acres scheduled for development. On March 9, 1999, the Siting Board found that the site was in conformance with the existing land use plans and zoning ordinances. On June 1, 1999, the Administrative Law Judge conducted a public hearing on the environmental impacts of the Cane Island project.

The Order approves and adopts the Order of Adoption as submitted by the Administrative Law Judge, pursuant to the Florida Electrical Power Plant Siting Act, sections 403.501, et seq., F.S., finding the proposed project complies with the legislative intent as stated in section 403.502, F.S., by providing abundant, low cost energy and by effecting a reasonable balance between minimal environmental impacts and the need for the facility as determined by the Florida Public Service Commission, by being in compliance with the State and Osceola County comprehensive plans and by complying with the applicable non-procedural standards of the Department of Environmental Protection and other agencies.
